DR et al v. Michigan Department of Education et al
Filed: October 18, 2016 ◆§ 2:16-cv-13694-AJT-APP
A lawsuit has been filed against the Michigan Department of Education alleging that not enough has been done to help public school in the wake of the Flint water crisis.
A class action has been filed against the Michigan Department of Education, Genessee Intermediate School District, Flint Community Schools and other entities that alleges not enough has been done to address the needs of the area’s public school children in the wake of the Flint water crisis. The 133-page complaint describes the state of Michigan’s alleged failure to “provide the resources and support essential to enable the Flint public education system” to meet the needs of its school children as an “unprecedented educational and civil rights disaster.”
The case was filed on behalf of roughly 30,000 school-age children in Flint who reportedly have a higher risk of developing a disability as a result of elevated levels of lead found in drinking water. The prolonged exposure to lead-filled water, the suit says, calls for continual community-wide screenings and evaluations to determine whether certain children may be eligible for special education programs and services. The proposed class includes individuals ages three to 26 and their parents who live in Flint who have been exposed to lead and may be eligible to receive special education and related service.
