Miami-Dade County Clerk for the Courts Harvey Ruvin and Linebarger Goggan Blair & Sampson LLP are the defendants in a proposed class action claiming the parties charged Florida residents unearned collection fees on unpaid civil penalties, fines, and court cost orders. According to the case, the unlawful collection fees are automatically imposed by “robo-calculation” prior to any actual legal services or collection activity, with the money allegedly going direct to the Miami-Dade County Clerk’s office. These allegations stem from a Florida statute that prohibits collection fees exceeding 40 percent of the amount owed on unpaid fines or court costs.
