Meyer Njus Tanick, PA is facing a proposed class action lawsuit that claims the debt collector filed misleading court documents against two Michigan consumers in an attempt to collect their alleged debts. According to the complaint, the plaintiffs each received a court summons that, under the defendants section, listed each man’s name and address, his address written a second time, and then the words “jointly and severally,” which the case says indicates "both the named individual and the address are sought to be held liable." This format could imply that each action was filed against both the debtor and his property, the suit argues, which was “misleading and intimidating” to the plaintiffs.
“The unsophisticated consumer is not familiar with the law relating to the enforcement of claims against property, and may not understand that before property can be affected by a claim based on a credit card or similar debt, a judgment must be entered against the individual consumer and subsequent proceedings taken to enforce the judgment against property,” the complaint reads.
The lawsuit argues that the debt collector “made false representations” regarding the plaintiffs’ debts and therefore violated federal debt collection law.
