A Texas man has filed a proposed class action lawsuit over allegations that defendant Merchants and Professional Credit Bureau, Inc. violated the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims the defendant, in a response to his dispute of a debt, sent a notice containing certain language that purported it to be operating as or employed by a consumer reporting agency, specifically with statements that it is “affiliated with over 400 credit bureau and bonded collection offices” and that it may report debtors’ account information to other credit bureaus.
The complaint argues the defendant’s conduct violates the FDCPA because, in truth, it had “no intention, nor could they have, reported any late payments or missed payments” to credit bureaus. These statements were merely made by the defendant as a scare tactic to convince the plaintiff (and proposed class members) to make payments.
