A Wisconsin woman claims in a proposed class action that defendant Merchants & Medical Credit Corporation, Inc. sent her a collection notice that unlawfully included a misleading and confusing validation notice. Citing potential Fair Debt Collection Practices Act (FDCPA) violations, the July 2017 letter sent by the defendant included the phrase “the debt collector or collections agency,” which the case claims implies there could be multiple parties from whom validation may be requested. The lawsuit argues the plaintiff, i.e. the unsophisticated consumer, would be confused by such language because it is uncommon for multiple debt collectors to reach out to a consumer over the same debt.
