Dematteis et al. v. Merchants & Medical Credit Corporation
Filed: August 3, 2017 ◆§ 2:17-cv-04566
Merchants & Medical Credit Corporation is facing a proposed class action lawsuit alleging it sent collection letters that failed to clearly identify consumers’ creditors.
New York
Merchants & Medical Credit Corporation is facing a proposed class action lawsuit alleging it sent collection letters that failed to clearly identify consumers’ creditors. The plaintiffs claim they received a letter from the defendant dated August 16, 2016 regarding an alleged debt that stated: “Re: CTCA EASTERN.” According to the complaint, the letter failed to specifically identify any entity as “creditor,” “original creditor,” “current creditor,” “account owner,” or “creditor to whom the debt is owed.” Therefore, the suit says, the letter violated the Fair Debt Collection Practices Act and hindered the plaintiffs’ ability to determine the company to whom they should make payments.
