A proposed class action against Mercantile Adjustment Bureau, LLC alleges the company sent the plaintiff a collection notice that would likely be misconstrued.
New York
A proposed class action against Mercantile Adjustment Bureau, LLC alleges the company sent the plaintiff a collection notice that would likely be misconstrued by the least sophisticated consumer. According to the lawsuit, the defendant violated the Fair Debt Collection Practices Act (FDCPA) by failing to disclose whether the individual’s balanced owed, as listed in the collection notice, could increase due to interest or fees. In this scenario, the case claims, the plaintiff was left uncertain as to whether the listed “current balance” was increasing, and if full payment of the stated balance would satisfy the debt.
