A chiropractic firm in West Virginia has filed a proposed class action lawsuit against Meditab Software, Inc. over allegations that it sent unsolicited fax advertisements in violation of federal law. The plaintiff claims it received two faxes (one on October 3, 2016 and the other on March 20, 2017) from the defendant advertising its goods and services. Citing the Junk Fax Prevention Act of 2005 (an amendment of the Telephone Consumer Protection Act of 1991), the suit claims the faxes were illegal because the plaintiff never provided the defendant with “express invitation or permission” to send the advertisements.
