The makers of defective pelvic mesh products are facing a lawsuit filed on behalf of Medicare Advantage Organizations who were allegedly never reimbursed for paying medical expenses associated with injury caused by the products.
Specifically, the lawsuit claims the defendants – C.R. Bard, Inc.; Sofradim Production, SAS; Tissue Science Laboratories; and settlement administrator Garretson Resolution Group – neglected to repay the plaintiffs from a fund set aside through a settlement agreement between the manufacturers and those who suffered personal injury related to the defective pelvic mesh. The plaintiffs argue that as secondary payers on the individuals’ insurance plans, they were the entities that should have been reimbursed through the settlement fund for the conditional payments of their enrollees’ medical expenses.
