A consumer claims The Zack Group - a Kansas-based medical staffing service - sent him a promotional text message without his prior express consent to do so.
A Missouri consumer has filed a proposed class action against The Zack Group, Inc. over claims that the Kansas-based medical staffing service sent him a promotional text message without his prior express consent to do so.
The consumer alleges that the defendant sent him a text message in June 2018 that stated:
“Hey Lucas, Interested in travel RN contracts for days/nights in MO? $1300-1700/wk aft tax dep on location. All skill sets.”
According to the complaint, the defendant sent the text message using an automatic telephone dialing system without obtaining the plaintiff’s prior express written consent, which is required under the Telephone Consumer Protection Act.
The suit seeks to represent a national class of consumers who received unsolicited texts from the defendant regarding job placement services, as well as a subclass consisting of similarly situated consumers whose phone numbers were provided to the defendant by the Missouri State Board of Nursing.
