A proposed class action lawsuit out of Florida district court claims Managed Care of North America, Inc., which does business as MCNA Dental Plans, Inc., violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited automated text messages advertising its dental benefits services. The 15-page lawsuit seeks injunctive relief and statutory damages for proposed class members.
The lawsuit says the defendant’s alleged text messages encouraged recipients to visit its website. The defendants, who reportedly service around four million people across the country, allegedly used “a combination of hardware and software systems” to automatically send thousands of text messages without first receiving prior consent. The plaintiff claims no prior relationship existed between her and the defendant before she started receiving the unauthorized text messages.
