A PA doctor claims he received at least one unsolicited junk fax from MCMC LLC without providing consent to be contacted via facsimile.
A Pennsylvania physician has filed a proposed class action against MCMC LLC over alleged junk faxes advertising courses available through the International Academy of Independent Medical Evaluators. The defendant, a for-profit provider of managed care programs, allegedly sent the plaintiff a facsimile in April 2017 without including the opt-out notice required by the Telephone Consumer Protection Act (TCPA). According to the suit, the plaintiff did not provide the defendant with express permission to receive advertisements by fax. Moreover, the case argues that by sending the unsolicited fax message, MCMC effectively misappropriated the plaintiff’s fax machine – including toner, paper and employee time – for its own use.
