McCarthy, Burgess & Wolff, Inc. is facing another proposed class action over alleged non-FDCPA-compliant collection notices sent to consumers.
A proposed class action filed in Illinois claims McCarthy, Burgess & Wolff, Inc. sent the plaintiff a collection notice in which the law firm attempted to tack onto the man’s debt impermissible “miscellaneous charges” and other fees. The case claims the defendant’s conduct violates the Fair Debt Collection Practices Act (FDCPA), as the firm allegedly did not disclose that the stated balance included these add-ons.
