The plaintiff alleges McCarthy, Burgess & Wolff made an offer to settle his debt that threateningly demanded payment within an unreasonable time period.

McCarthy, Burgess & Wolff, Inc. finds itself as the defendant in a proposed class action in which the plaintiff claims he received an “offer to settle” letter that he says threateningly required payment to be made in an unreasonable amount of time. According to the lawsuit, the defendant’s November 2017 notice offered to settle the plaintiff’s obligation for “.00% off the full balance, or $499.90.”
“This statement is deceiving and misleading on its face as [the defendant’s] offered ‘Settlement Amount’ is not a reduced offer of settlement, but merely payment in full,” the lawsuit points out.
The case takes further issue with the deadline set by the defendant by which the plaintiff needed to submit payment. The lawsuit alleges the deadline – only 14 days – is merely a deceptive tactic meant to rush the plaintiff into paying his obligation.
