According to the 63-page lawsuit, the Superior data breach involved the theft of certain files from its computer network by an unauthorized third party between May 15 and May 23 of last year.
Per the data breach suit, the incident exposed the private information of approximately 858,000 individuals who currently receive Superior’s medical transportation services or have used them in the past.
The case says that the compromised data may include names, addresses, dates of birth, Social Security numbers, driver's license or state ID numbers, financial account information and payment card details. Medical diagnoses, treatment data, patient record information and health insurance details also may have been exposed, the complaint adds.
The filing alleges that Superior’s negligent cybersecurity is to blame for the data breach, arguing that the company failed to maintain proper safeguards to protect the confidential information stored in its network.
As a result of the defendant’s allegedly negligent conduct, victims are now at a heightened risk of being targeted for cybercrimes and will be “for years to come,” the lawsuit charges.
To make matters worse, Superior also waited until last month to alert data breach victims via a notice posted to its website, the suit asserts. The case contends that the online notice was not only delayed but lacked critical details about the incident, including how cybercriminals gained access to the company’s computer systems, who was behind the cyberattack and what steps have been taken to secure stored data in the future.
The lawsuit looks to represent anyone in the United States whose private information was accessed and/or acquired by an unauthorized third party as a result of the data breach that occurred within Superior Air-Ground Ambulance Service’s computer systems in May 2023.
