Maury Cobb, Attorney at Law, LLC is the defendant in a proposed class action claiming the agency violated the terms of the Fair Debt Collection Practices Act (FDCPA) with its attempts to collect a debt owed to T-Mobile. The lawsuit, filed in Wisconsin, claims the defendant sent the plaintiff a collection notice that included both an offer to settle the debt, an offer purportedly valid until only a certain date, and a validation notice.
The case argues that the notice sent to the plaintiff is confusing to the unsophisticated consumer because, while it demands payment of the debt within the 30-day validation period, it does not explain how the validation notice and settlement “deadline” fit together.
“The unsophisticated consumer would have no idea how to both seek verification of the debt and preserve the settlement offer in [the collection notice],” the lawsuit says.
