Maury Cobb & Associates LLC is on the receiving end of a proposed class action lawsuit that claims it sent a collection letter that violated provisions of the Fair Debt Collection Practices Act (FDCPA). According to the suit, the language in the letter falsely implied to the plaintiff that the communication he received was from a law firm and that an attorney was closely involved in the collection of his debt. The complaint further argues that though the letter identified an “original creditor,” it failed to specify the “creditor,” “current creditor,” or “creditor to whom the debt is owed,” in violation of the FDCPA.
