Puffy is facing a Florida man’s lawsuit in which he alleges the Los Angeles-based online mattress retailer unlawfully sent him a promotional text message.
Puffy, LLC is facing a Florida man’s proposed class action in which he alleges the Los Angeles-based online mattress retailer unlawfully sent him a telemarketing text message.
The complaint says that in August 2018, the plaintiff created an online account with the company and input his phone number. Despite never giving permission to be contacted or engaging in any transaction with the defendant, the plaintiff alleges he received a text message containing a coupon about an hour after creating his account. The case argues the defendant “knew or should have known that its conduct was a violation of the [Telephone Consumer Protection Act].”
