An Ohio chiropractic clinic has filed a proposed class action claiming The Massachusetts Medical Society unlawfully sent unwanted junk faxes.
Ohio chiropractic clinic Physicians Healthsource, Inc. has filed a proposed class action claiming The Massachusetts Medical Society unlawfully sent unwanted junk faxes to at least 40 recipients in violation of the Telephone Consumer Protection Act (TCPA). The plaintiff claims the advertisement faxes were sent by the defendant without first receiving prior express permission or establishing business relationships.
“There is no reasonable means for Physicians Healthsource (or any other class member) to avoid receiving unauthorized faxes,” the case reads. “Fax machines are left on and ready to receive the communications their owners desire to receive.”
