A lawsuit alleges that Solstice Benefit Services and Solstice Benefits violated the TCPA by sending faxes without recipients’ “prior express invitation or permission.”

A proposed class action alleges that Solstice Benefit Services, Inc. and Solstice Benefits, Inc. violated the Junk Fax Prevention Act by sending fax advertisements without recipients’ “prior express invitation or permission.”
The lawsuit was filed in Florida federal court and alleges that the defendants sent the plaintiff, a Massachusetts-based dentist, an unsolicited fax in April 2018 offering him the opportunity to be a provider for several dental healthcare plans. The case claims that the defendants sent unsolicited faxes to at least 40 other recipients without lawfully obtaining their prior express permission to do so.
