A proposed class action lawsuit claims Maoz engages in unlawful telemarketing by sending automated text message advertisements to consumers without obtaining their prior consent.
The plaintiff in the case says she received a text message (pictured below) from the vegetarian restaurant on April 8, 2019 that encouraged her to use a “$5 egift” to order food online.
The woman claims that at “no point in time” did she provide Maoz with her express written consent to be contacted using an automated telephone dialing service, arguing that the “impersonal and generic nature” of the text indicates that it was sent using such technology.
The lawsuit alleges that the defendant, Maoz Development, LLC, has sent “thousands” of similar text message advertisements to consumers nationwide who never gave the company permission to do so.
