A proposed class action lawsuit claims that AscensionPoint Recovery Services, LLC sent a collection notice that was out of step with Fair Debt Collection Practices Act (FDCPA) requirements. The July 2018 letter, addressed to the estate of a deceased man, attempted to collect medical debts the man allegedly owed, the suit says. The letter supposedly failed to identify any specific debt or creditor as required by the FDCPA, and instead vaguely referred to “outstanding bills.” In addition, the case argues the letter did not disclose the plaintiff’s debt dispute rights, nor that the communication was from a debt collection agency attempting to collect the obligation, in further violation of the FDCPA.
