A New York man has filed suit against Vital Recovery Services, LLC claiming the debt collector sent him a letter that failed to comply with the Fair Debt Collection Practices Act.
A New York man has filed suit against Vital Recovery Services, LLC claiming the debt collector sent him a letter that failed to comply with the Fair Debt Collection Practices Act (FDCPA). According to the suit, the letter indicated to the plaintiff that the stated balance may increase due to interest, late fees, or “other charges.” The case argues that the defendant has an obligation under the FDCPA “not just to convey the amount of the debt, but to convey such clearly.” Though the defendant listed the amount of the plaintiff’s alleged debt at the time the letter was sent, it failed to specify the interest rate, the nature of the other charges, and the timing of when such charges would be added to the balance, according to the suit. The debt collector thereby robbed the plaintiff of the information he needed to calculate the true amount of his debt on a given day, the complaint says.
