A Wisconsin man has filed suit against Oliphant Financial, LLC over claims that the debt collector failed to clearly identify his alleged creditor.
A Wisconsin man has filed suit against Oliphant Financial, LLC over claims that the debt collector failed to clearly identify his alleged creditor. The man supposedly received a collection letter from the defendant indicating that Oliphant was the “current creditor” but also referring to the entity as the “servicer of this account,” implying, according to the complaint, that the defendant was merely collecting payments on behalf of the creditor.
Further, the letter allegedly represented that the defendant had purchased the account from “Lending Club” but also labeled another entity – WebBank – as the original creditor, which the suit claims “would further obscure Oliphant’s relation to the alleged debt in the eyes of the unsophisticated consumer.”
The complaint argues that the unsophisticated consumer would be unsure upon reading the letter “whether the debt had been sold to a third-party debt buyer, and if so, to whom.”
