A New York man has filed suit against Gold Key Credit, Inc. claiming the defendant failed to clearly identify his alleged creditor as obligated under the Fair Debt Collection Practices Act.
A New York man has filed suit against Gold Key Credit, Inc. claiming the defendant failed to clearly identify his alleged creditor as obligated under the Fair Debt Collection Practices Act. According to the suit, the defendant sent the plaintiff a collection letter dated March 3, 2017 that listed his “Original Creditor” as “Siena Emergency Medical Svc PC,” yet instructed him to send all communications and payments to Gold Key Credit, Inc., which it specified as the “servicer” of his account. The suit claims the letter failed to explain what a “servicer” is, and argues that the least sophisticated consumer, after reading the language in the letter, would be unable to determine with certainty to which entity the debt is purportedly owed.
