A proposed class action has been filed against DirecTV, LLC and Cable Vision CCTV, Inc. over claims that the companies unlawfully withdrew money from a consumer’s account without his authorization.

A proposed class action has been filed against DirecTV, LLC and Cable Vision CCTV, Inc. over claims that the companies unlawfully withdrew money from a consumer’s account without his authorization. According to the suit, the plaintiff provided his debit card number to the defendants over the phone but canceled his DirecTV service two days later, “prior to any installation of any equipment or activation of any services.” The defendants’ representative informed the man that he would not be charged, the case continues, but the companies allegedly debited two charges – one for $390.58 and another for $433.45 – from his account that same day, causing him to incur an overdraft fee.
“Plaintiff never provided Defendant with any authorization to deduct these sums of money from Plaintiff’s banking account,” the complaint argues. “Further, Defendants did not provide to Plaintiff, nor did Plaintiff execute, any written or electronic writing memorializing or authorizing these recurring or automatic payments.”
Under federal law, the suit argues, the defendants were not permitted to withdraw money from the plaintiff’s account without first obtaining his written or electronic authorization.
