Amcol Systems, Inc. is on the receiving end of a proposed class action lawsuit that accuses it of sending a Wisconsin consumer a misleading debt collection letter that violated the Fair Debt Collection Practices Act.
Amcol Systems, Inc. is on the receiving end of a proposed class action lawsuit that accuses it of sending a Wisconsin consumer a misleading debt collection letter that violated the Fair Debt Collection Practices Act. The letter allegedly indicated the plaintiff’s balance equaled $50.00 and then stated the following:
“Accounts over $50.00 not paid in full, may be reported as a bad debt collection item(s) on your credit bureau record after the time period described below.”
According to the complaint, this statement was “objectively false and misleading” because it left the plaintiff, who allegedly owed exactly $50.00, unable to determine whether his account would be reported to credit reporting agencies.
