Alltran Financial, LP is facing a New York resident’s allegations that a collection letter the company sent him failed to comply with the Fair Debt Collection Practices Act. In a proposed class action, the man claims the defendant’s collection notice contained an “[amount] due as of July 27, 2017,” implying, according to the complaint, that the balance would increase in the future. The suit argues that the credit card account referenced in the letter had been “charged-off” and was no longer subject to interest or other fees that could cause the amount of debt to increase. Therefore, the case alleges, the defendant’s statement was an attempt to falsely threaten the plaintiff into paying off the debt quickly to avoid additional charges.
