Nashville Pharmacy Services, Llc v. Mammoth Meds.Com, Inc. et al
Filed: July 19, 2018 ◆§ 3:18cv671
MammothMeds.com has been named in a lawsuit alleging that the company violated the Telephone Consumer Protection Act by sending junk faxes to consumers.
Mammoth Meds.com, Inc. has been named in a lawsuit alleging that the company violated the Telephone Consumer Protection Act (TCPA) by sending illegal junk faxes. The plaintiff, a company that owns and operates pharmacies in Tennessee, says it received unsolicited faxes from the defendant in February 2018 that did not contain proper opt-out notices. The suit further alleges that the plaintiff never gave "prior express invitation or permission" to the defendant, which supposedly sent similar unsolicited fax advertisements to at least 40 other recipients.
The plaintiff seeks compensation for damages such as the cost of paper and ink used to print the faxes and interruption of privacy. According to the lawsuit, sending fax advertisements without the prior express permission of the recipient is prohibited under the TCPA.
