The nine-page Malibu Boats lawsuit was filed by a Virginia consumer who says he bought a boat designed by the Tennessee-based manufacturer in 2022. The plaintiff contends he was not warned by the company that allegedly poor design can cause the components of the anchoring system to “saw” the line that connects the boat to the anchor as it is deployed, compromising the cord’s integrity.
The consumer claims that in August 2022, the alleged flaw caused his boat’s anchor line to sever from the craft, and it drifted in open water until beaching on a sand bar. The man was stranded and had to be rescued by the United States Coast Guard in a “harrowing helicopter extraction,” the suit shares.
As a result of the allegedly defective anchoring system, the plaintiff had to pay out of pocket to tow the boat to shore and repair the substantial damage it sustained, the case asserts. The boat has diminished in value because of the incident, the complaint adds.
“[Malibu Boats] is aware or should have been aware of the design defects but failed to rectify them or provide adequate warnings to users,” the filing charges.
The Malibu Boats lawsuit looks to represent any persons or entities in the United States who, in the past five years, purchased a boat designed, manufactured and sold by the company that incorporates the same anchoring system for personal or household use.
