Malen & Associates, P.C. is the defendant in a lawsuit filed by two consumers who claim the debt collector failed to specify the amount of their alleged debts.
Malen & Associates, P.C. is the defendant in a proposed class action filed by two consumers who claim the debt collector failed to specify in collection letters the amount of their alleged debts, in violation of the Fair Debt Collection Practices Act. The letters supposedly contained a “balance due,” but neglected to mention whether interest would accrue or extra fees would be added. The suit argues that the plaintiffs’ alleged debts were indeed subject to interest and late fees, and that the defendant’s failure to disclose any additional charges would leave the unsophisticated consumer “confused” and “uncertain” as to the amount he or she actually owed.
