Makower Abbate is facing a lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA) and Michigan's Regulation of Collection Practices Act (RCPA).

A proposed class action lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA) and Michigan’s Regulation of Collection Practices Act (RCPA) has been filed against Makower Abbate and Associates PLLC, which does business as Makower Abbate Guerra Wegner Vollmer. The 30-page complaint claims the defendant is unlawfully publicizing private condo lien information beyond the requirements set by the Michigan Condominium and Foreclosure Statute. According to the plaintiff, every Notice of Lien Foreclosure Sale that the defendant sends out advertising that a debt collector is pursuing a Michigan homeowner whose debt is in default “ignores the homeowners’ right to privacy” and to the protections provided by the FDCPA and RCPA.
