Maker of Air Wick Aerosol Spray Hit with Fraud Lawsuit Over Odor Killing Claims

Akwei et al. v. Reckitt Benckiser LLC
Filed: August 11, 2017 ◆§ 1:17-cv-06080
The maker of Air Wick aerosol sprays is fending off a proposed class action alleging the product cannot truly eliminate odors, despite label claims.
A proposed class action lawsuit filed in New York claims defendant Reckitt Benckiser LLC, the company behind Air Wick aerosol sprays, made false and misleading statements about its product in claiming it can eliminate odors. The 41-page complaint contends Air Wick cannot eliminate odors, but merely masks unwanted stenches.
“[The plaintiffs] and other consumers have been harmed by [the defendant’s] unlawful fraud,” the case claims, “which takes advantage of consumers’ strong preference for products that actually remove unwanted odors rather than merely mask them.”
The lawsuit notes the following Air Wick fragrances in particular:
- -Vanilla Indulgence
- -Lavender & Chamomile
- -Apple Cinnamon Medley
- -Fresh Waters
- -Magnolia & Cherry Blossom
- -Freesia & Jasmine
- -Hawai’i Exotic Papaya & Hibiscus Flower
In addition to obtaining monetary relief, the lawsuit hopes to require Reckitt Benckiser to end its allegedly deceptive marketing, packaging and advertising practices for its Air Wick sprays.
