Maker of Air Wick Aerosol Spray Facing More Litigation Over Allegedly False Representations
Sims v. Reckitt Benckiser, LLC
Filed: September 26, 2018 ◆§ 1:18-cv-06565
A consumer alleges Reckitt Benckiser has falsely advertised its Air Wick product, claiming it “merely masks odors” rather than eliminating them entirely.
The company that manufactures and sells Air Wick aerosol room sprays is on the receiving end of another proposed class action in which a consumer claims the product cannot, in fact, eliminate odors. According to the 26-page complaint, defendant Reckitt Benckiser, LLC has falsely and deceptively advertised and labeled its Air Wick product, which the plaintiff claims “merely masks odors” rather than eliminating them entirely.
The Air Wick fragrances mentioned in the lawsuit include:
- Vanilla Indulgence;
- Lavender & Chamomile;
- Apple Cinnamon Medley;
- Fresh Waters;
- Magnolia & Cherry Blossom;
- Freesia & Jasmine; and
- Hawai’i Exotic Papaya & Hibiscus Flower.
From the complaint:
“[Reckitt Benckiser] has unjustly profited in the lucrative market for odor-eliminating products by labeling its Products deceptively and selling them to consumers who sought to purchase products that can actually eliminate unwanted odors, such as smoke, food, mildew, bathroom, and pet odors.”
