MagicJack faces a class action lawsuit claiming the company called consumers' cell phones without consent to do so.
Two consumers are behind a proposed class action in which they claim defendant Magicjack LP placed automatically dialed calls to their cell phones without prior express written consent to do so. Citing potential Telephone Consumer Protection Act (TCPA) violations, the complaint states the plaintiffs each received at least one call from Magicjack in 2018 advertising the company’s online voice call services.
“[The defendant] placed these calls with a predictive dialer with the capacity to store and dial a list of telephone numbers without human intervention,” according to the lawsuit.
