MA Resident Claims PCL Construction Owes Renters After Power Outages

A MA man has filed a class action against PCL construction to recover damages for those who couldn't access their Outer Banks vacation rentals.

A Massachusetts man has filed a proposed class action against PCL Construction Enterprises, Inc. and PCL Civil Constructors, Inc. alleging he and other Outer Banks vacationers were unable to use their rental units—and received no refunds—as a result of damage the companies caused to vital power transmission lines last month. After alleging the defendants acted negligently when they inadvertently cut power to Hatteras and Ocracoke Islands off the coast of North Carolina in late July, the lawsuit claims the plaintiff and others who booked rental units on the islands were unable to access their properties once the state’s governor ordered a mandatory evacuation during peak vacation season.
The proposed class covered by the lawsuit includes anyone who was renting or made a payment to rent vacation properties in the area impacted by the damage PCL allegedly caused to a power transmission line near Bonner Bridge during the time period of the state-imposed mandatory evacuation.
