Lyft Named in Consumer’s TCPA Suit Over ‘Unwanted’ Text Message

Lyft, Inc. has been named in a proposed class action lawsuit alleging the company violated the Telephone Consumer Protection Act (TCPA) by sending an unsolicited text message to a consumer’s cell phone. The plaintiff says he began filling out an application to become a driver for the defendant’s ride-sharing service but never submitted the form for processing. Sometime after that, he supposedly received the following text message from the defendant on his cell phone:
“Complete your Lyft driver application today to earn big on New Year’s Eve, our biggest night of the year. Finish now: http://lft.to/1TR7PGC”
The man claims he never consented to receive text messages from Lyft and did not have “an established business relationship” with the company at the time he received the text. According to the suit, the unwarranted message – which was allegedly sent using automated dialing technology – invaded the plaintiff’s privacy, leaving him “frustrated and distressed.”
