A blind New York woman has filed a proposed class action lawsuit against Lulu Frost, Inc. over claims that the jewelry and accessories store failed to make its website accessible to blind internet users.
A blind New York woman has filed a proposed class action lawsuit against Lulu Frost, Inc. over claims that the jewelry and accessories store failed to make its website accessible to blind internet users. The complaint claims that lulufrost.com provides online shoppers with the ability to view and buy products, learn about sales, and find information about store hours and locations, among other functions. The plaintiff alleges, however, that she was unable to complete a transaction – purchasing a pair of earrings – using her screen-reading software as a result of the site’s various access barriers. From the complaint:
“These barriers are pervasive and include, but are not limited to: lack of alt-text on graphics, inaccessible drop-down menus, the lack of navigation links, the lack of adequate prompting and labeling, the denial of keyboard access, empty links that contain no text, redundant links where adjacent links go to the same URL address, and the requirement that transactions be performed solely with a mouse.”
The lawsuit argues that as a consequence of these obstacles, the defendant’s website discriminates against the blind population in violation of the Americans with Disabilities Act and denies them “full and equal access to, and enjoyment of, the goods, benefits and services of lulufrost.com and the Lulu Frost Stores.”
