Lucille Roberts Health Clubs Inc. is the defendant in a proposed class action that claims the company send unsolicited and unconsented-to text commercial text messages to consumers’ cell phones in violation of the Telephone Consumer Protection Act (TCPA).
The lawsuit says the plaintiff provided her phone number to the defendant as part of a guest registration process but never expressed any consent to be contacted by the company. After being asked if she was interested in joining the club as a member, the plaintiff allegedly declined. A few days later, the case claims, the unsolicited text messages allegedly began coming into the plaintiff cell phone through an automated telephone dialing system.
