A lawsuit has been filed against debt collection agency LTD Financial Services. The suit claims the defendant failed to clearly communicate in a debt collection letter.
A proposed class action has been filed in New York against debt collection agency LTD Financial Services, LP. The suit claims the defendant violated provisions of the Fair Debt Collection Practices Act by failing to clearly communicate in a debt collection letter the amount owed by the plaintiff. The letter specified the “Balance” allegedly owed to Bank of America, but failed to note whether interest was included in the stated amount or whether it would accrue, the suit claims. According to the complaint, “[a] reasonable consumer could read the notice and be misled into believing that he or she could pay her debt in full by paying the amount listed on the notice.” The plaintiff claims the letter left her unsure of how much she actually owed; she could not be certain that any payment she made would settle the alleged debt.
