A proposed class action out of New Jersey federal court accuses LTD Financial Services, L.P. of sending a collection letter that misled a consumer as to his debt dispute rights.
According to the suit, the plaintiff received the notice in August 2018 regarding an obligation purportedly owed to Barclays Bank. The letter allegedly stated, in part:
“If you notify this office in writing within 30 days after receiving this notice that you dispute the validity of this debt or any portion thereof, this office will obtain verification of the debt or obtain a copy of a judgement, if any, and mail you a copy of such verification or judgement.”
The case argues the notice failed to explicitly state that a dispute must be made in writing. Further, by beginning the statement with “if,” the suit continues, the debt collector implied that submitting a dispute in written form was voluntary, leaving the plaintiff “confused as to what his actual requirements were for properly disputing the debt.”
