A Center Valley, Pennsylvania private medical practice claims in a proposed class action that National Imaging Associates, Inc. violated the Telephone Consumer Protection Act (TCPA) by sending junk advertisement faxes to at least 40 recipients without express permission. The faxes in question allegedly touted radiology benefits management services available through RadMD.com. According the suit, the defendant sent out “satisfaction survey” faxes as a pretext to “increase awareness and use of [its] healthcare management services and to increase traffic” to its website.
“[The defendant’s] unsolicited faxes damaged [the plaintiff] and other class members,” the case alleges. “Unsolicited faxes tie up the telephone lines, prevent fax machines from receiving authorized faxes, prevent their use for authorized outgoing faxes, cause wear and tear on the recipients’ fax machines, and require additional labor to attempt to discern the source and purpose of the unsolicited message.”
