Florida's Lokey Automotive Group is the defendant in a case claiming it unlawfully sent promotional text messages without consent.
Lokey Automotive Group, Inc., which does business as Lokey Volkswagen in Clearwater, Florida, is facing a proposed class action that alleges it sent autodialed promotional text messages to consumers' cell phones without obtaining prior express consent. The complaint says the text messages encouraged recipients to schedule appointments for vehicle repairs.
The plaintiff claims the defendant obtained from a third party, Recall Masters, Inc., lists of potential customers who own vehicles subject to recalls that were never addressed. These lists allegedly included proposed class members’ names and cell phone numbers, as well as the year, make and model of their cars. The plaintiff argues she received a text from the defendant concerning a recall for her 2003 Volkswagen Jetta even though she hadn’t taken her car to Lokey Volkswagen in more than 10 years.
