Litigation Continues to Roll In Over Samsung 'Exploding' Washers Recall

Another proposed class action lawsuit takes issue with an allegedly inherent defect in Samsung's washing machines that consumers say can cause them to explode.
Another proposed class action is taking issue with an allegedly inherent defect in Samsung’s washing machines that consumers say can cause them to explode or suffer other catastrophic calamities in the course of normal use. This latest action, filed in Delaware, claims the plaintiff purchased a Samsung washer in July 2016, months before the company’s November 2016 recall commenced. The options provided by Samsung as part of the recall were less than ideal for many consumers, the plaintiff argues:
“None of the options were available to the plaintiff because: (1) the retrofit that Samsung proposed does not actually fix the defect in the machine so that [the plaintiff] can use the machine as they intended at purchase; (2) the rebate would have paid for a fraction of the cost of replacement; and (3) [the plaintiff] purchased her machine more than 30 days prior to the recall.”
The case was filed on behalf of consumers nationwide who purchased any of the recalled washing machines between March 2011 and November 2016 and seeks an injunction halting any further sales of the pulled machines, as well as reasonable monetary damages for putative class members.
Listed as defendants in the 39-page lawsuit are Samsung Electronics America, Inc., Samsun Electronics Co., Ltd., The Home Depot, Inc., Lowe’s Home Centers, LLC, Best Buy Co., Inc., and Sears Holding Corporation.
