Liberty Capital Group, Inc. is facing a proposed class action lawsuit alleging it sent a chiropractic business a fax advertisement in violation of the Junk Fax Prevention Act of 2005.
Liberty Capital Group, Inc. is facing a proposed class action lawsuit alleging it sent a chiropractic business a fax advertisement in violation of the Junk Fax Prevention Act of 2005. According to the complaint, the fax was sent without the plaintiff’s prior consent and did not contain the required opt-out language informing the recipient of how to prevent future faxes. The suit argues that “[t]here is no reasonable means for [the plaintiff or any other proposed class member] to avoid receiving unauthorized faxes.”
