A proposed class action out of New Jersey court claims defendant LG Electronics USA, Inc. manufactured and sold refrigerators containing as many as two design defects – a “fan defect” and an “ice maker defect.” The lawsuit alleges the fan defect can result in the refrigerators’ fans malfunctioning, which can result in the premature spoilage of foods. The alleged ice maker defect can cause in-door ice makers to jam, the case continues.
According to the complaint, the alleged fan failure defect occurs typically in conjunction with a build-up of ice, which can result in a stoppage of cold air from circulating throughout the fridges. The plaintiff claims many consumers have experienced these problems, even after repairing their fridges.
“No class member can rely on a ‘repair’ actually having remedied the problem with his or her class refrigerator for a reasonable period going forward,” the lawsuit alleges, adding LG was allegedly aware of the problem and received complaints from consumers for more than six years without updating its sales materials or specification sheets for the products.
Summarily, LG Electronics has allegedly taken “no meaningful steps to protect its customers from purchasing defective refrigerators, to warn consumers about the defects prior to sale, to change the design and/or manufacturing process to permanently remedy either of the defects, or devise a permanent repair for either defect.”
