John C. Heath, Attorney at Law (aka Lexington Law Firm) is facing a suit that claims it committed TCPA violations by texting and calling consumers.
Colorado
A proposed class action filed in Colorado claims John C. Heath, Attorney at Law, PLLC (which operates as Lexington Law Firm) violated the federal Telephone Consumer Protection Act (TCPA) by unlawfully sending marketing text messages and placing automatically dialed phone calls to consumers’ cell phones without prior consent. The plaintiff claims she received four phone calls and voice messages from the defendant on her cellphone on consecutive days in July 2017 informing her that the law firm can help with disputes with credit bureaus. That same month, the plaintiff says, she received text messages asking if there was a better time for her to speak with one of the defendant’s consultants.
The lawsuit claims these alleged advertisement calls were placed and text messages sent to the plaintiff without consent and without proper mandatory disclosures, including a way for the woman to opt-out of receiving the communications.
