Lexington Law Firm finds itself as the defendant in a proposed class action that alleges the firm violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited telemarketing text messages to consumers.
Echoing similar lawsuits filed back in 2017, the plaintiff claims that in October 2018 he received several text messages from the defendant in which the firm advertised its credit repair and monitoring services. According to the case, the defendant failed to obtain the man’s express written consent before contacting him using an automatic telephone dialing system and continued to send the texts despite the plaintiff’s demand to opt out.
