Lenwich Holdings LLC, Lenwich Asset Management LLC, and Lenwich HQ LLC are facing a proposed class action lawsuit filed by a blind New York man who alleges the defendants’ website is not fully accessible to blind users. The suit argues that the site, www.Lenwich.com, is “heavily integrated” with the defendants’ physical sandwich stores and is considered a “place of public accommodation” under the Americans with Disabilities Act (ADA). As such, the defendants are obligated to provide equal access to the site for sighted and visually impaired users alike, the complaint claims.
The lawsuit takes issue with the site’s supposed lack of alternative text, which hinders blind users from being able to interpret site content with screen-reading technology. The complaint further argues that the site’s empty and redundant links result in confusion and unnecessary repetition.
As a result of its alleged access barriers, the plaintiff says he was unable to fully enjoy the website’s goods and services, including information about store locations and hours, store specials, reviews, nutritional information, and the ability to order food online.
