Lending Biz Solutions Rung Up in Junk Fax Class Action Case
Last Updated on May 8, 2018
Scoma Chiropractic, P.A. v. Hernandez
Filed: December 20, 2017 ◆§ 2:17cv707
The individual who runs Lending Biz Solutions faces a lawsuit alleging the company sent unwanted junk faxes in violation of the TCPA.
An individual who does business as Lending Biz Solutions is on the receiving end of a proposed class action in which the plaintiff, a Florida chiropractic office, alleges the defendant sent unsolicited junk fax messages in violation of federal law. The plaintiff, citing potential Telephone Consumer Protection Act (TCPA) issues, claims it never gave the defendant prior express permission to send the fax message in question on November 14, 2017. The case notes the fax contained mandatory opt-out language—a common gripe in TCPA junk fax lawsuits—yet was still sent without permission or the existence of an established business relationship.
